Terms & Conditions (Legal)

1) Definitions

• Item(s): Any food or beverage offered or received via the Platform.
• Sharer: A user who lists or provides Items.
• Recipient: A user who requests or receives Items.
• Users: Sharers and Recipients collectively.
• Listing: Any post describing Items for Sharing.

2) Eligibility & Capacity

You represent and warrant that you are at least 18 years old and legally capable of entering into binding agreements.

If you are under 18, all interactions and pickups must be conducted exclusively by a parent or legal guardian, who assumes full responsibility.

3) Permitted Use & Prohibited Items

The Platform is strictly for non-commercial food sharing.

Do not list or provide: alcohol; tobacco; cannabis; narcotics; controlled substances; pharmaceuticals, vitamins, or supplements; illegal or restricted items; non-food items.

Do not share Items that are opened, partially used, expired, damaged, contaminated, improperly stored, or otherwise unsafe for human consumption.

Where visible, accurately state any Use-By/Best-Before dates. If unknown, clearly disclose “date unknown.”

Do not misrepresent ingredients, allergens, or condition. If uncertain, state “ingredients/allergens unknown.”

4) Sharer Responsibilities

You assume full and exclusive responsibility for the safety, quality, integrity, legality, labeling, storage, handling, and suitability of Items you provide.

You must comply with all applicable laws and regulations (including food safety, hygiene, packaging, and transport).

You agree that NeerNow does not collect, store, handle, transport, inspect, certify, test, or verify Items.

5) Recipient Responsibilities & Acceptance of Risk

By receiving, handling, transporting, or consuming Items, you acknowledge and voluntarily assume all risks, including but not limited to illness (e.g., foodborne illness), allergic reactions, injury, property loss, or disputes arising from in-person interactions.

You are solely responsible for your own inspection and judgment before consuming any Item.

6) Platform Role (No Agency; No Insurance)

NeerNow is a neutral technology platform that only connects Users and is not a producer, seller, reseller, distributor, handler, insurer, agent, or representative of any User or Item.

Title or possession of Items transfers directly between Users; NeerNow is not a party to any transaction and provides no logistics or delivery service.

NeerNow does not perform background checks or food safety verification.

7) No Warranty (AS-IS / AS-AVAILABLE)

The Platform and all Listings/Items are provided “AS-IS” and “AS-AVAILABLE.”

NeerNow makes no warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted/error-free operation.

8) Disclaimer; Release & Limitation of Liability

NeerNow does not inspect, verify, or guarantee the safety, quality, legality, or accuracy of Items or Listings.

To the maximum extent permitted by law, you release, discharge, and hold harmless NeerNow and its owners, officers, employees, contractors, and agents from any and all claims, demands, damages, losses, liabilities, costs, illnesses, injuries, or disputes—known or unknown, direct or indirect—arising from or relating to Items, Listings, interactions, or use of the Platform.

In no event shall NeerNow be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or any loss of profits, data, goodwill, or business, even if advised of the possibility of such damages.

Where liability cannot be excluded by law, it is limited to the lesser of: (a) the amount you paid (if any) to NeerNow in the 12 months preceding the event; or (b) €50.

9) Indemnification

You agree to indemnify, defend, and hold harmless NeerNow and its affiliates and representatives from any claims, damages, losses, costs, and reasonable legal fees arising out of: (i) your use of the Platform; (ii) your Items or Listings; (iii) your interactions with other Users; or (iv) your breach of these Terms or applicable law.

10) User Conduct; Compliance; Reporting

You will act lawfully, respectfully, and safely.

NeerNow may—at its sole discretion—remove Listings, suspend/terminate accounts, or restrict access for violations or risks, without notice.

Users may report suspected violations; NeerNow may act but has no obligation to monitor, pre-screen, or enforce.

11) Privacy

Your use is also subject to the Privacy Policy (as published or updated on the Platform). Do not share sensitive personal data in Listings or messages.

12) Changes; Termination

NeerNow may revise these Terms or modify/terminate the Platform at any time. Continued use after a change constitutes acceptance.

You may cease use at any time; clauses intended to survive (including 5–9, 11–16) shall survive termination.

13) Governing Law & Jurisdiction

These Terms are governed by the laws of Belgium and the European Union.

Exclusive jurisdiction and venue lie with the courts of Brussels, Belgium, without regard to conflict-of-laws principles.

Consumer mandatory rights that cannot legally be waived remain unaffected.

14) Severability; No Waiver; Assignment; Entire Agreement; Third Parties; Language

If any provision is held invalid or unenforceable, the remainder remains in full force.

Failure to enforce is not a waiver.

You may not assign these Terms without NeerNow’s prior written consent; NeerNow may assign freely.

These Terms constitute the entire agreement between you and NeerNow regarding Sharing.

No third-party beneficiaries are intended.

In case of any inconsistency between language versions, the English version controls.
